BREAKING NEWS ICJ HEARING BEGINS IN THE HAGUE NICARAGUA ASKS ICJ TO END GERMAN MILITARY EXPORTS TO ISRAEL
April 8, 2024Nicaragua presented its submissions at the International Court of Justice today requesting the court order Germany to halt military arms exports to Israel and to resume its funding of U.N. Palestinian refugee agency UNRWA, saying there is a serious risk of genocide in Gaza.
Nicaragua’s agent ambassador Carlos Jose Arguello Gomez told the court Berlin had violated the 1948 Genocide Convention by continuing to supply Israel with arms after ICJ judges ruled it was plausible that Israel violated some rights guaranteed under the genocide convention during its assault on Gaza.
“There can be no question that Germany (…)was well aware, and is well aware, of at least the serious risk of genocide being committed,” in the Gaza strip, Arguello Gomez said.
He told the judges that Berlin was ignoring its obligations under international law by continuing to provide military assistance to Israel.
“This has got to stop,” Arguello Gomez said.
In concluding remarks, Gomez read out Nicaragua’s request for the ICJ to order the following provisional measures:
Germany must immediately suspend its aid to Israel, in particular its military assistance.
Germany must immediately ensure that military equipment or weapons or other equipment used for military purposes already delivered by Germany and German entities to Israel are not used to commit or to facilitate serious violations of the Genocide Convention or international humanitarian law.
Germany must resume its support and financing of UNRWA.
NOTE: Germany accounts for around 30% of all arms exports to Israel.

Carlos Jose Arguello Gomez: From the public statements made by Germany, we could note two alleged justifications for the continued support of Israel ,that Israel is not violating the Genocide Convention, and that it has a right to defend itself. It’s a precedent. This is the bottom line. And whatever the basis or definition, a so-called right of self-defense is invoked, it can never serve to justify violations of the norms of the Genocide Convention or the norms of international Humanitarian law. Surprisingly, Germany seems not to be able to differentiate between self-defense and genocide. Furthermore, Germany cannot invoke that Israel is in some state of necessity of its assistance for its defense and survival. In spite of the size and population, Israel is on the top 10% of the most militarily powerful countries in the world, its per capita expense is more than four times larger than that of Germany. It is even higher than that of the United States. Its total yearly military expenditure, going back many years, is higher than that of its neighbors, Iran and Egypt, that have a population more than ten times larger and immense territories in comparison with Israel.
