July 26, 2024Israel unlawfully OCCUPIES the West Bank, Gaza Strip and East Jerusalem therefore it has NO RIGHT to self-defence in these areas.
As the occupier it must abide by International Humanitarian Law which Israel has ignored, defied and stomped on with the whole world witnessing.

Mehdi Hassan: You said Israel does not have a right to self-defense because it’s an occupier and occupiers don’t have a right to self-defense against the occupied. Explain what you mean by that, because people will be taken aback when they hear that for the first time.
Francesca Albanese: Yes, I’ve said there is no question whatsoever that Israel has the right to protect itself from aggression. It has the right to protect its citizens and its territory. But its territory does not include the West Bank, the Gaza Strip and East Jerusalem. These are territories that Israel occupies unlawfully. But as long as it is the de facto occupying power, it is to abide by international law. So the applicable framework is international humanitarian law, which allows Israel to respond to threats, to security threats according to law and order. So it cannot invoke the right of self-defense under article 51 of the UN charter, which is the authorization of any country to repel an attack, to use lethal force, to wage a war against another country. Here we are talking of the population Israel occupies. And also, of course, there have been arguments: “Gaza is not occupied because in 2005 Israel removed the colonies”. Yes, but the colonies are not a determinant to the effect of establishing whether there is an occupation or not. Effective control is that determinant. And there is no question whatsoever in UN resolution, let’s say in the assessment of UN agencies that Gaza is still occupied, it was still occupied before the seventh of October.
Mehdi Hassan: Yeah, people get very upset about that. And Israelis are like “ we evacuated our settlements”. But you control the airspace, the borders, the sea, the population registry. That very much is an occupation.
