THE LEGALS BOMBSELL: DID NAWAF SALAM OUTSMART EVERYONE?
Article 13 might be the most important clause in this whole agreement, and almost nobody explained what it actually says. Here’s the full picture, and my theory about who wrote it.
Nawaf Salam spent years on the bench at the International Court of Justice and served as its president. It’s very hard for me to believe that a jurist with that depth of expertise in the law of state responsibility did not know precisely what a clause like Article 13 can—and cannot—actually do.
My own suspicion is that he knew all along that no bilateral political text can sign away rights that international law itself protects.
If that’s right, then allowing that language into the agreement may have been a calculated move—giving Washington and Israel something that looks like a compromise, while never actually surrendering rights that cannot lawfully be surrendered in the first place.
